Daniel Rashbaum is an experienced trial lawyer. His practice focuses on white collar criminal defense, internal investigations, regulatory enforcement, and qui tam litigation. He has represented individuals and institutions in numerous high-profile matters, including those involving alleged violations of the federal securities and commodities laws, Foreign Corrupt Practices Act (“FCPA”) matters, price fixing, allegations of violations of anti-bribery and anti-kickback statutes, insider trading, money laundering offenses, export violations, and fraud against health care benefit programs.

Dan has been recognized by Chambers USA for his “tenacious and energetic” approach, for being “excellent on his feet with unrelenting energy and problem-solving,” and for being a “fabulous trial lawyer.”

It is with this energy and problem-solving ability that Dan has represented countless number of individuals and companies around the globe in inquiries brought by agencies including, among others, the Department of Justice, the Department of Health and Human Services, the Securities and Exchange Commission, the U.S. Office of the Comptroller of the Currency, the Financial Crimes Enforcement Network, the Office of Foreign Assets Control, and local United States Attorney’s Offices and state attorney generals’ offices.

Prior to being a Founding Member of Marcus Neiman & Rashbaum LLP, Dan was a Principal at Kobre & Kim LLP and before that served as an Assistant United States Attorney in the U.S. Attorney’s Office for the Southern District of Florida. While serving as an Assistant United States Attorney, Dan was responsible for conducting more than 30 jury trials (never losing a case that went to verdict) and argued several cases before the U.S. Court of Appeals for the Eleventh Circuit. Before serving as an Assistant United States Attorney, Dan practiced at Skadden, Arps, Slate, Meagher & Flom, LLP and Morvillo, Abramowitz, Grand, Iason & Anello, P.C., focusing on white collar criminal defense and complex civil litigation.

Raised in Hollywood, Florida, and a graduate of Pine Crest School, Dan earned his B.A., from Northwestern University and his J.D., magna cum laude, from Cornell University Law School.

  • Representation of New York Republican Congressman Michael Grimm, a sitting member of the United States House of Representatives, who is charged in a 20-count Indictment alleging tax offenses, fraud, perjury and obstruction tied to his former ownership of a Manhattan fast-food eatery
  • Representation of the former founder and managing director of Clover Asset Management, based in the Cayman Islands, who was arrested as part of a DOJ and IRS money laundering and bank fraud sting operation. After a contested sentencing, the client received a sentence of 14 months – far below the recommendation of DOJ prosecutors
  • Representation of an individual in pre-trial negotiations with the Manhattan District Attorney’s Office involving a “pump and dump” stock fraud investigation. Client ultimately was given a non-prosecution agreement.
  • Representation of George Levin in SEC v. Levin, an SEC enforcement action related to Scott Rothstein’s $1.2 billion Ponzi scheme. Levin created several investment companies that, collectively, were the largest “feeder” funds that invested in Rothstein’s Ponzi scheme.

  • Representation of one of the nation’s leading ocular oncologists and retinal surgeons in connection with a Federal Grand Jury investigation.
  • Representation of several senior executives of a national hospital corporation in connection with an investigation by the Department of Justice and the Department of Health & Human Services into alleged violations of the Anti-Kickback Statute and Stark Law.
  • Internal investigation on behalf of sports franchise regarding pharmaceutical issues.
  • Representation of New York Republican Congressman Michael Grimm, a sitting member of the United States House of Representatives, who is charged in a 20-count Indictment alleging tax offenses, fraud, perjury and obstruction tied to his former ownership of a Manhattan fast-food eatery

  • Representation of employees and managers of a national hospital provider in a False Claims Act investigation involving to allegations of conspiring to provide kickbacks to medical practitioners in exchange for patient referrals.
  • Representation of several executives at a large pharmaceutical company in a qui tam action against the company and an investigation by the Department of Justice into alleged off-label marketing practices by the company
  • Representation of an individual in a wrongful death lawsuit in the Southern District of California.
  • Representation of physician owners of a large Miami-Dade hospital in dispute relating to squeeze-out merger and pursuit of appraisal rights.
  • Representation of a company with regards to a product liability lawsuit.
