The firm represents Bart Hernandez, a well-known Major League Baseball player agent who has been indicted for allegedly conspiring to assist high-profile Cuban-born baseball players to illegally enter the United States. No players have been charged but the indictment features a number of them, including Seattle Mariners outfielder Leonys Martin and Chicago White Sox All-Star first baseman Jose Abreu.
The case involves novel legal issues concerning the enforcement of the Cuban embargo, the interplay of the Cuban Adjustment Act and other federal criminal immigration statutes and the process by which MLB teams sponsor Cuban players for work visas. Hernandez faces multiple charges as well as forfeiture in excess of $14.5 million related to all agent fees earned through his past and continued representation of the players.
